Taqleed: The Most Knowledgeable Requirement

Perhaps the most discussed requirement for choosing a Marji’ is the requirement that the person must choose the most knowledgeable Marji’. Questions that come up include: how do we define knowledge? Who is to say that one Marji’ is more knowledgeable than another Marji’ and who is qualified to rank scholars based on knowledge? All of these are important questions that must be answered. However, the real issue as of late has been the attempt by some people to do away with this requirement. We will discuss these questions and the concerns which follow.

The Verse of Mubahaleh: An Overview

Tonight marks the anniversary of the Mubahaleh between the Holy Prophet (S) and the Christians of his time. The Eid is celebrating the victory of Islam on that day and the withdrawal of the Christians fearing the consequences of a prayer against them from AhlulBayt (A). This is the day when the religion was challenged and the Holy Prophet (S) chose Ali, Fatimah, Hassan and Hussain to face that challenge with him. Is Ziyarat Ashoora’ Authentic?

A number of people have raised questions and doubts as of late about the authenticity of Ziyarat Ashoora’. The questions raised fall into three groups: 1) Does the Ziyarah even have a proper chain of narration which indicates that an Imam said it? 2) Does this proper chain of narration cover the statements of cursing that is found in the Ziyarah or are these statements added at a later point? 3) Why would AhlulBayt (A) spend their time cursing others and ask their followers to do the same?. The last question is one of interpretation and goes to the philosophy and wisdom of cursing and whether it’s proper or not and that is outside the scope of this entry but will be answered later on. Why do Shia combine prayers?

Many people question why Shia combine Duhr and Asr prayers and Maghrib and Isha’ prayers and whether this is something that is from the religion or of their own invention. When we review the opinions of the different Islamic schools of thought we see that they all allow combining prayers but they differ on what circumstances makes it okay to do so. The Maliki, Shafi’I and Hanbali schools of Fiqh said combining prayers is allowed if the person is travelling and some said it is also allowed during circumstances of fear, rain or sickness. The Hanafi school of Fiqh said it is only allowed on the day of Arafah (9th of the month of Haj. The school of AhlulBayt (A) said it is allowed in all circumstances. We will examine the verses of the Holy Quran, the Hadeeths of the Holy Prophet (S) and the sayings of AhlulBayt (A) to see which opinion has the most support.

Every Muslim knows that Allah (SWT) has established certain acts of worship (e.g. Salah, Sawm, Hajj, etc.) and certain ways of dealings (e.g. Marriage, Contracts, Inheritance, etc.). This knowledge by the person is not something they are doing Taqleed in because it falls under the “clearly defined” or “indisputable” exceptions in the statement above.

If one knows that she must perform certain acts and conduct dealings in accordance with Allah's instructions, it follows logically that she must learn these instructions and attain them in order to follow them. Before we begin answering this question there is a point that must be clear. The question of what material may the person pray on is a question of jurisprudence (Fiqh). Questions of Fiqh must be addressed to the appropriate religious authority and their ruling on it is what should be followed.

This point is important because in many discussions between people of different sects, people start asking each other why do you do this or that and all the questions are related to Fiqh. Although there are differences in matters of Fiqh between people of different sects, the fundamental differences between Islamic sects are differences of beliefs and therefore that should be the focus of the discussion.
